Terms of Use

Last updated 17 October 2026 (draft)

Draft. This page is being reviewed by a Kenyan advocate and may change before SokoSwift Kenya opens.

These terms explain the rules for using SokoSwift Kenya. By creating an account or posting an ad you agree to them. We’ve kept them as short and plain as we can.

1. What SokoSwift Kenya is

SokoSwift Kenya is an online classifieds marketplace. We provide the website that lets people and businesses post ads and contact each other. We are not a party to any sale. The agreement for any item, house, job or service is between the buyer and the seller, landlord or employer.

2. Your account

  • You must be at least 18 years old to create an account.
  • Give accurate information. You sign in with your email address and password (or, where we offer it, your phone number and a code we send by SMS). Never share your password or sign-in code; you are responsible for activity on your account.
  • If you sell as part of a business (a shop, dealer, agent or landlord with several properties), use a business account, so buyers know who they’re dealing with.
  • One person or business per account. Don’t create accounts to get around a ban, and don’t pretend to be someone else.

3. Posting rules

Every ad must be for a real item, house, job or service that you have the right to offer, at an honest price, with real photos and an accurate description.

You must not post ads for:

  • Anything illegal to sell or own in Kenya
  • Firearms, ammunition, explosives and other weapons
  • Narcotic drugs, prescription-only medicines, and medicines not approved by the Pharmacy and Poisons Board
  • Counterfeit or stolen goods, including phones that are blocked, reported stolen or have a changed IMEI
  • Wildlife, game meat and trophies, or any protected species
  • Alcohol, tobacco, shisha and vapes
  • Adult content or services
  • Loans, investments, betting, pyramid schemes and “get rich quick” offers
  • Personal data, SIM cards registered to someone else, accounts, documents or ID
  • Jobs that charge applicants any fee

Livestock and poultry are allowed in Agriculture & Livestock. Sellers must have any movement permits the law requires and must not sell sick animals.

You must not:

  • Post misleading prices, fake ads, or the same ad many times
  • Ask for viewing fees, booking fees, registration fees or any money before the buyer has seen the item or house
  • Send fake M-Pesa messages, phishing links, or ask anyone for their M-Pesa PIN or sign-in code
  • Harass, threaten, impersonate or discriminate against other members, or post false information about them
  • Scrape the site, collect members’ phone numbers, or send them unsolicited messages
  • Post fake reviews or pay for reviews

Fraud, phishing, impersonation, identity theft and harassment are also crimes under the Computer Misuse and Cybercrimes Act 2018. We will remove the content, close the account, and share information with the police or the Directorate of Criminal Investigations where the law allows.

4. Houses and jobs

Landlords, caretakers and agents must advertise real, available houses at the real rent, and must not charge viewing fees. Agents must be registered where the law requires. Employers must follow Kenyan employment law, must not ask applicants for money, and agencies recruiting for jobs abroad must be licensed by the National Employment Authority.

5. Paid extras (M-Pesa)

  • Posting ads is free. You can pay for optional extras, such as boosting an ad to the top, a featured spot or a business package. The price in Kenya shillings and what you get are shown before you pay, and include any taxes we must charge.
  • You pay with M-Pesa on your own phone. We never see or ask for your M-Pesa PIN. Your M-Pesa receipt appears in your account.
  • Paid ads are always labelled “Top” or “Featured”. Free ads are never hidden.
  • If a paid extra doesn’t work as described, contact us within 14 days and we’ll put it right or refund you to the same M-Pesa number. If we remove an ad for breaking these rules, the extra on that ad is not refunded.

6. Moderation and complaints

Anyone can report an ad or member using the Report button. We aim to review reports within 24 hours, and may remove ads or suspend accounts. If we remove your ad and you think we’ve made a mistake, or you want to complain about how we handled something, use our contact form and we’ll look again.

7. Ads, expiry and your content

Ads run for 14 days and can be renewed free of charge, as often as you like. You keep ownership of what you post, but you give us permission to display it on SokoSwift Kenya and to use it to promote your ad (for example, sharing it on our social media). Only post photos you took or have permission to use.

8. Our responsibility

We work hard to keep SokoSwift Kenya safe, but we can’t check every ad or guarantee that items are as described, that sellers will deliver, or that buyers will pay. Please follow our safety tips. Nothing in these terms takes away your rights under the Consumer Protection Act 2012 or any other law that can’t be excluded.

9. Changes and ending your account

We may update these terms and will tell you about important changes by SMS, email or on the site. You can delete your account at any time from Settings. We may suspend or close accounts that break these terms.

10. Law

These terms are governed by the laws of Kenya, and the courts of Kenya can hear any dispute about them.
